StepsApp Terms of Service
These Terms of Service govern your access to and use of the StepsApp apps, websites, and related services. By using StepsApp, you agree to these terms.
1. Acceptance of Terms
By downloading, accessing, or using StepsApp, you confirm that you have read and accepted these Terms of Service and our Privacy Policy.
If you do not agree, do not use StepsApp.
2. Eligibility and Account Responsibilities
You must be at least the age of digital consent in your country (or have consent from a parent/legal guardian where required by law) and be legally capable of entering into a binding agreement to use StepsApp. If you use StepsApp on behalf of an organization, you confirm you are authorized to bind that organization.
- Keep your account credentials secure.
- Provide accurate information where required.
- You are responsible for activity under your account.
3. Subscriptions, Billing, and Trials
Some features require a paid subscription. Subscription prices, billing periods, and trial terms are shown in-app before purchase.
- Payments are processed by Apple App Store or Google Play, not by StepsApp directly.
- Subscriptions auto-renew unless canceled before the renewal date.
- Refunds are handled according to the policies of the app store where you purchased.
- We may change pricing at any time to the extent permitted by applicable law and app store rules.
4. License and Acceptable Use
We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use StepsApp for personal, non-commercial use, subject to these terms.
Prohibitions: You may not:
- Reverse engineer, decompile, or attempt to extract source code, except where law permits.
- Use StepsApp to violate laws or third-party rights.
- Interfere with the operation or security of StepsApp.
- Use automated tools to scrape, overload, or abuse our services.
- Use StepsApp to send spam, malware, fraudulent content, or abusive/harassing content.
- Bypass technical limitations, access controls, or subscription restrictions.
- Use StepsApp in any way that could damage, disable, or impair our systems or other users' access.
5. User Content
If you upload or share content through StepsApp, you retain ownership of your content.
You grant us a worldwide, non-exclusive, royalty-free license to host, process, reproduce, adapt (for technical formatting), and display that content only as needed to operate, secure, and improve the service.
You are solely responsible for your content and confirm you have all rights required to upload or share it.
6. Intellectual Property
StepsApp and its trademarks, logos, software, designs, and content are owned by StepsApp GmbH or its licensors and are protected by applicable intellectual property laws.
Except for the license above, these terms do not grant you ownership rights in StepsApp.
7. Third-Party Services and Links
StepsApp may integrate with or link to third-party services. We are not responsible for third-party content, services, availability, security, or policies. Your use of third-party services is governed by their terms and privacy policies.
Apple and Google are not responsible for support, maintenance, or warranty obligations related to StepsApp beyond what is required under their own terms.
8. Suspension and Termination
We may suspend, restrict, or terminate access immediately, with or without notice, if you violate these terms, create legal or security risk, fail to pay applicable fees, or misuse the service.
You may stop using StepsApp at any time. Terms that should reasonably survive termination remain in effect, including intellectual property, licenses, disclaimers, limitations of liability, indemnity, and dispute provisions.
9. Disclaimers
StepsApp is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, availability, and data accuracy.
StepsApp is not a medical device and does not provide medical advice, diagnosis, treatment, or emergency services. Do not rely on StepsApp for medical decisions.
10. Limitation of Liability
To the maximum extent permitted by law, StepsApp GmbH and its affiliates are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, revenue, profits, goodwill, or business opportunities arising from or related to your use of StepsApp.
Where liability cannot be excluded, our total aggregate liability for all claims related to StepsApp is limited to the amount you paid for StepsApp in the twelve months before the event giving rise to the claim.
Nothing in these terms limits liability that cannot be limited under applicable law, including mandatory consumer rights.
11. Indemnification
You agree to defend, indemnify, and hold harmless StepsApp GmbH, its affiliates, directors, employees, and partners from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your misuse of StepsApp, your violation of these terms, or your infringement of third-party rights.
12. Changes to These Terms
We may update these terms from time to time. If changes are material, we will provide notice in-app or via our website. By continuing to use StepsApp after the updated terms take effect, you accept the updated terms.
13. Governing Law and Dispute Resolution
These terms are governed by the laws of Austria, excluding conflict-of-law rules. If a dispute cannot be resolved amicably, disputes are subject to the competent courts in Graz, Austria, unless mandatory consumer protection laws provide otherwise.
14. Severability, No Waiver, and Assignment
If any provision of these terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
Our failure to enforce any provision is not a waiver of that provision. You may not assign or transfer these terms without our prior written consent. We may assign these terms in connection with a merger, acquisition, reorganization, or sale of assets.
15. Force Majeure
We are not liable for any delay or failure to perform resulting from events beyond our reasonable control, including network outages, platform interruptions, acts of government, natural disasters, labor disputes, or failures of third-party services.
